1 Provider 

2. Registration and conclusion of contract

(1) If you wish to purchase a subscription, you must first register free of charge by providing an e-mail address.

(2) The website is not an offer. By clicking on the ‘Buy now’ button in the last step of the checkout, you submit a legally binding offer. Immediately before submitting this order, you can check it again and correct it if necessary. You will receive an order confirmation by e-mail (within one working day at the latest) in response to your order, which will finalise the contract.

(3) The offer is aimed solely at customers of legal age in UK and European Union. 

3. Contents of the Playground

(1) The content of the Playground can be viewed on the website. We reserve the right to add new games to the Playground and to make improvements or changes to existing games.

(2) kr3m endeavours to adapt the Playground to new device and browser versions in a timely manner. Compatibility with the current browser versions is guaranteed.

(3) The Playground can be used with or without registration and by subscription. Use as a subscription offers a range of additional features and enables use without advertising.

4. Payment

(1) Payments can be made by credit card, direct debit or PayPal and are always made via our payment service provider Stripe ( http://stripe.com/).

(2) All prices are inclusive of VAT.

(3) You are responsible for the online or telecommunication connection required for access and its costs.

5. Cancellation policy

Right of cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the date of conclusion of the contract.

To exercise your right of cancellation, you must inform us (kr3m.media GmbH, Kaiserstr. 142-144, 76133 Karlsruhe, Germany. Tel. +49 (0)721 183959-0 info@kr3m.com) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You can use the attached sample cancellation form, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of cancellation

If you cancel this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to cancel this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

If you have requested that the service should commence during the cancellation period, you must pay us a reasonable amount corresponding to the proportion of the services already provided by the time you inform us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.

6. Rights of use

(1) All rights to the content of the Playground belong to kr3m. The user is authorised to use the games privately during the term of the contract.

(2) Commercial use is not permitted without separate authorisation from kr3m, nor is any other use, such as integration into another website, including by way of framing, copying the content or duplicating or otherwise making it publicly available, for example by recording the user's own game and publishing it on other websites (Let's Play videos).

(3) Access to the games by robots, bots, etc. is not permitted. The manipulation of games or game results such as high scores or result lists is also prohibited.

(4) If the user is permitted to use a comment function, the linking of other websites in these comments is not permitted.

7. Online access

(1) The Playground can be used with or without registration.

(2) Various functions require registration, e.g. choosing a player name, saving game progress or entering high scores. These functions can be changed by kr3m at any time. You choose an account name and password to access these functions. You must treat this data confidentially and protect it against unauthorised access. Disclosure to third parties is prohibited. If you lose your password or become aware of any misuse of your access, you must inform us immediately. You will then receive new access.

8. Cancellation

(1) The subscription runs until cancelled. The contract can be cancelled by either party at any time to the end of the month. Cancellation by the user can be declared under ‘My account’ under the link ‘Manage game subscription’ by a simple click.

(2) Cancellation of the subscription may result in the deletion of game data and user-generated content (e.g. comments etc.).

9. Warranty for defects

The statutory warranty rights apply.

10. Player names

(1) The user is free to choose his/her own player name. He has no right to be granted the desired player name.

(2) kr3m can change a player name at any time. This applies in particular if there is a possibility of an infringement or other type of impairment of third-party rights. This is the case, for example, if a choice of name infringes third-party trademark, company or name rights or could be considered offensive. The same applies to political, religious or other expressions of opinion.

(3) The player name can be displayed in high score lists together with any profile picture that may be stored.

11. Profile picture

(1) If the user can upload a profile picture to his/her name, he/she is responsible for ensuring that this upload does not infringe any third-party image rights or copyrights. If a person is depicted in the profile picture, it may only be the user himself.

(2) If the user logs in via a social media account, their respective profile picture can be integrated into the game profile.

(3) The user is liable to kr3m for any costs arising from images uploaded by him/her due to the infringement of third-party rights.

(4) kr3m only uses profile pictures in the context of the Playground.

12. Cheats

The use of software to influence one's own or others' game results or the high score lists is not permitted. kr3m is authorised to block the user concerned and delete his high score values.

13. Comment function

If kr3m provides a comment function, users are required to use it in an objective, lawful and friendly manner. kr3m reserves the right to delete comments that violate this or are off-topic.

14. Competitions in the Playground

(1) Insofar as kr3m organises competitions for registered participants of the Playground who have registered their e-mail address, the following applies.

(2) Details of the competition, the duration of the event, the options for participation and the prizes can be found in the respective competition description.

(3) Participation is only permitted for natural persons over the age of 18 who are resident in UK and European Union. Employees of kr3m.media GmbH and all of its subsidiaries’, registered address is Kaiserstr. 142-144, 76133 Karlsruhe, Germany and all of its subsidiaries are excluded from participation.

(4) Participation in competitions is only possible by providing an e-mail address. Permission to participate relates solely to private use and is subject to the condition that the participant refrains from using the competition for commercial, political, illegal or immoral purposes. Multiple participation by one person is not permitted. The same applies to the registration of third parties or via competition clubs etc. In particular, it is not permitted to carry out automated registrations for the competition using technical means. Registered persons who violate this rule or whose registration was made in violation of this rule will be excluded from participation. The same applies to participants who attempt to manipulate the competition process.

(5) Prizes will be drawn. The winners of a competition will be notified by e-mail. If a winner notified by e-mail does not provide an address within a period of 7 days, their prize will be forfeited. The prize will then be awarded to another participant. Cash redemption is excluded.

(6) Data protection notice: The data collected from participants as part of the competition will be used by kr3m as part of the competition. By taking part in the competition, the user agrees that their postal address will be passed on to the named sponsor solely so that they can send the prizes.

(7) kr3m does not guarantee that a competition will be available without interruption at all times. In particular, kr3m is not responsible for technical faults that are not within its sphere of influence. This also includes wilful acts by third parties that may impair or cancel the running of the competition.

(8) It is not permitted to send a competition link as spam or to addressees who do not wish to receive it. The participant is liable for any damage caused by violations.

(9) Legal recourse is excluded for participation in the competition.

15. Data protection

(1) Reference is made to the data protection declaration regarding the use of participant data by kr3m, in particular for the improvement of the offer.

(2) We would like to point out that the website https://zaphira.games/ is a subdomain of the offer https://www.kr3m.com/. The provider's privacy policy applies to the use of this website.

16. Severability clause

Should a clause of these terms and conditions be invalid, the validity of the remaining terms and conditions shall remain unaffected.

17. Online dispute resolution

The European Commission provides a platform for online dispute resolution, which you can find at http://ec.europa.eu/consumers/odr/ . We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
